What to do with copyrighted songs

If I allow my users to upload songs, and they add music that is copyrighted, how do I deal with this?  I want to keep the website nice and legal.

Contact the BMI / ASCAP and read.  More than likely you are going to have to get each artist or end user to:

 

1- Hold you harmless in the event your are sued.

2- Have them submit proof they have permission, especially if its for sale - they will be liable for royalties to the publisher and songwriter.

 

If its just for listening purposes - Paying BMI and ASCAP will usually do the trick to keep you legal.  Just like radio stations, restuarants, bars, and clubs have to pay each time they have a performance of a song.
